The following terms and conditions (“Terms”) constitute a legally binding agreement that governs participation in the Club 52 Rewards Program (the “Program”) and all rewards, offers, free slot play, complimentaries, and redemptions associated therewith (collectively, “Benefits”). These Terms apply to all Program members (each, a “Member”). Please read the following Terms carefully as they set forth your rights and obligations as a Member, with respect to participation in the Program. Enrollment in the Program constitutes your acceptance of these Terms. If you do not agree to these Terms, please do not enroll or participate in the Program.
Effective June 1, 2017
1. How to be a part of the Program
1.1. Membership in the Program is available to any individual person that (i) is twenty-one (21) years of age or older; (ii) is a resident of a country that legally permits participation in the Program; (iii) possesses valid and unexpired government-issued photo identification (“ID”); (iv) is not ineligible to play at a casino facility in the United States or elsewhere, either through a government program or by their own request; and (v) has not been terminated from the Program or barred from the SLS Las Vegas Property.
1.2. Acceptable forms of ID include the following: Valid State issued Driver’s License, Government Issued Passport, State issued ID, or a Military ID.
1.3. The Program is limited to individuals only; corporations, associations, groups, and other entities are not eligible to enroll or participate in the Program.
1.4. SLS Las Vegas may elect to modify, waive, or add additional eligibility requirements of the Program at any time at its discretion.
2. Joining Club 52
2.1. Eligible individuals may sign up for the Program at the Club 52 Desk located in the SLS Las Vegas. Limit one (1) Program account (“Account”) per individual. SLS Las Vegas reserves the right to deny any application for membership in the Program at its sole discretion and without recourse.
2.2. To sign up for the Program, each Member must provide the following information:
2.3. For eligibility verification purposes, activation of membership in the Program can only occur following the presentation of valid ID. The name issued on the valid ID must match the name on the Account. Any Member who signs up online must visit Club 52 Desk at SLS Las Vegas to verify eligibility and receive the Program card (“Club 52 Card”) before Benefits can be accrued or redeemed.
2.4. Upon membership activation, each Member must select a Personal Identification Number (“PIN”) for his/her Account. It is each ’Member’s responsibility to keep that PIN secure and confidential. Each Member is also responsible for all transactions on his/her Account when his/her PIN is used. Valid ID must be presented at Club 52 Desk located in the SLS Las Vegas to change a PIN.
2.5. Duplicate Club 52 Cards will be issued to a Member with proper ID. SLS Las Vegas are not responsible for lost or stolen Club 52 Cards.
2.6. Accounts cannot be combined among Members, their estates, successors, or assigns.
2.7. Membership in the Program and the accrual and redemption of Points are void where prohibited by law.
3. The Club 52 Rewards Card
3.1. The Club 52 Card is non-transferable, is the property of SLS Las Vegas and must be surrendered upon request.
3.2. Only the Member listed on the Account may request information about or engage in transactions related to the Club 52 Card or an Account. Each Member is responsible for notifying SLS Las Vegas if any information provided in connection with the Program has changed.
3.3. Any Club 52 Card that has been mutilated, forged, misprinted, altered, tampered with, mechanically reproduced, or obtained under fraudulent circumstances, as determined by SLS Las Vegas at its sole discretion, is automatically void and any or all Benefits will be cancelled.
4. Rules of Usage
4.1. Prior to engaging in game play, each Member is solely responsible for properly inserting their Club 52 Card into the card reader on the gaming device, or presenting the Club 52 Card to a table games supervisor.
4.2. Any Member that has any outstanding debt balances with SLS Las Vegas, including without limitation non-sufficient funds for a check cashed or casino credit not paid, may have all Benefits suspended or forfeited at the sole discretion of SLS Las Vegas until all discrepancies have been remedied. SLS Las Vegas shall decide whether to reinstate membership, Benefits, or Rewards Points in its sole and absolute discretion.
4.3. SLS Las Vegas will immediately suspend access to the Program and void any accrued Benefits for any Member who voluntarily requests to be restricted from or limited in certain activities and privileges at SLS Las Vegas. Further activity including gaming activity will not accumulate additional Rewards Points or Benefits.
4.4. SLS Las Vegas will immediately suspend access to the Program and void any accrued Benefits or Reward Points for any Member who is trespassed, excluded, or barred from SLS Las Vegas. Further activity including gaming activity will not accumulate additional Points or Benefits.
5. Tier Credit Structure & Earning
5.1. The Program is a four-tiered program. The four tiers are Preferred, VIP, Elite, and Legend. Each Member starts the Program at the Preferred membership tier.
5.2. Members advance to higher tiers by accumulating tier credits based on gaming play at the sole discretion of SLS Las Vegas. Members accrue tier credits during a six-month period. Earning periods are June 1 through November 30 and December 1 through May 1. Tier credits are distinct from Rewards Points and cannot be redeemed for Free Slot Play, food redemptions or other Program Benefits.
5.3. SLS Las Vegas may revise the method for earning tier credits at its discretion. The current schedule for earning tier credits is as follows: Members will receive one (1) tier credit for two dollars ($2.00) wagered on video poker. Members will receive two (2) tier credits for one dollar ($1.00) wagered on Slots. Members will receive one (1) tier credit for one dollar ($1.00) on Video Keno. Members will receive tier credits playing table games based on the type of table game, average bet and amount of time played, at SLS Las Vegas’s discretion. Members must satisfy minimum betting requirements at table games to earn tier credits. Please see a table games supervisor for assistance.
5.4. If a Member earns three thousand and one (3,001) tier credits within the six-month period, that Member achieves VIP membership. If a Member earns thirty thousand and one (30,001) tier credits within the six-month period, that Member achieves Elite membership. If a Member earns one hundred fifty thousand and one (150,001) tier credits within the six-month period, that Member achieves Legend membership. The Legend card level is based on management approval. After achieving a membership tier, the Member will retain that membership tier for the remainder of the earning period and the following six month earning period, provided the Member remains in good standing.
5.5. SLS Las Vegas may modify, change, or discontinue tier benefits and membership level qualifications at its sole discretion.
5.6. A Member may only redeem Benefits by presenting the Member’s valid Club 52 Card along with photo ID. Expired Club 52 Cards or IDs may not be used to claim Benefits.
6. Earning Reward Points and Redeeming Club 52 Benefits
6.1. Members earn Reward Points in accordance with their gaming activity and the amount of Reward Points earned will vary depending on the gaming device played. SLS Las Vegas may revise the method for earning Reward Points at its discretion. The current schedule for earning Reward Points is as follows:
6.2. Reward Points are redeemable for at least thirteen (13) months from the date they are earned. All non-redeemed earned Reward Points in an Account will expire and be removed if no gaming activity has occurred on the Account for a period of thirteen (13) months. Any gaming activity where a Club 52 Card is used to earn Reward Points or tier credits on a gaming device will qualify as gaming activity. SLS Las Vegas may change this criteria at its discretion.
6.3. A Member cannot earn Reward Points or any other Benefits if his or her Club 52 Card is used by another individual.
6.4. All Reward Points accumulations are subject to review and verification by SLS Las Vegas management. SLS Las Vegas reserves the right to adjust Reward Point balances for any reason, including, without limitation, computer error, machine malfunction, operator error, fraud, or other misuse of the Program.
6.5. Reward Points may be redeemed for food and beverage and free slot play . The redemption of two hundred fifty (250) Reward Points is equivalent to one dollar ($1.00) in redemption value for food and beverage, free slot play. This ratio may be revised or changed at SLS Las Vegas discretion. In order to redeem Reward Points for free slot play, a Member must use an appropriate slot machine at SLS Las Vegas to convert available Reward Points to free slot play and download free slot play into the Member’s Program account. While Reward Points are not earned for gaming activity on table games, complimentaries are earned at the discretion of SLS Las Vegas toward food, beverage and hotel rooms.
6.6. Free slot play converted from points will be valid for thirty (30) days after it is downloaded to the Member’s Account, after which time it will expire.
6.7. Reward Points are not redeemable for cash and have no cash value.
6.8. Members must present valid ID bearing the same name on record for his/her Club 52 Card in order to redeem Benefits. Redemption of Benefits are subject to limitations determined at the sole discretion of SLS Las Vegas.
6.9. Benefits are non-transferable under any circumstances, including, without limitation, in the event of death, a domestic relations matter or by operation of law, and cannot be combined among Members.
6.10. The Club 52 Card, Account, and Benefits cannot be sold, purchased, traded, or bartered.
6.11. Any Reward Points or Benefits that have been forged, altered, tampered with, mechanically reproduced, or obtained under fraudulent circumstances, as determined by SLS Las Vegas at its sole discretion, are automatically void and any or all Reward Points and Benefits will be cancelled.
6.12. Each Member is solely responsible for any tax liability resulting from his/her participation in the Program.
6.13. Reward Points may occasionally be earned through non-gaming activity, as determined by SLS Las Vegas in its sole discretion. Any Reward Points earned through non-gaming activity will be credited to the Member’s Account within twenty-four (24) hours after the activity and cannot be redeemed until they are credited to the Account. The Member is solely responsible for ensuring that Reward Points earned through non-gaming activity are properly credited. If Reward Points are not properly credited, the Member should mail a description of non-gaming activity that earned uncredited Reward Points to SLS Las Vegas at the address listed below. The Member’s correspondence should include the Member’s name, Account number, address, email, and phone number, along with a copy of any receipts or other evidence of the non-gaming activity. Members should allow approximately six to eight weeks for Reward Points to be credited to the Account. Any request to add or modify Reward Points credited must be received within ninety (90) days of the date they were earned.
7. Dispute Resolution
7.1. SLS Las Vegas has the sole and absolute discretion to interpret and apply these Terms, and all questions or disputes regarding the Program or these Terms will be resolved by SLS Las Vegas in its sole and absolute discretion.
7.2. Except where prohibited, any and all disputes, claims, and causes of action arising out of or connected with the Program or any Benefits shall be resolved individually, without resort to any form of class action, exclusively under NRS 463.362, or if determined by the Nevada Gaming Commission or Nevada State Gaming Control Board not to be subject to NRS 463.362, then by the United States District Court, District of Nevada or the appropriate Nevada State Court located in Clark County, Nevada. All issues and questions concerning the construction, validity, interpretation, and enforceability of the terms & conditions of Program, or the rights and obligations of Members and SLS Las Vegas in connection with the Program, shall be governed by, and construed in accordance with, the laws of the State of Nevada, without giving effect to any choice of law or conflict of law rules (whether of the State of Nevada or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Nevada.
8. Modifications to the Club 52 Program and General Conditions
8.1. SLS Las Vegas reserves the right, at its sole discretion and without prior notification, to cancel, revoke, amend, or modify: (i) the Program; (ii) any Member’s membership status, including, without limitation, access to the Program; and (iii) the accrual, availability, and redemption of any Benefits.
8.2. SLS Las Vegas may change or update these Terms at any time. These Terms were last updated as of the date at the top of this page. Any revisions to these Terms will take effect upon posting to the Program website. SLS Las Vegas will notify Members of any material changes to these Terms by sending an email to all active Members or by placing a notice on the Program website. All Members are encouraged to regularly review the current version of these Terms on the Program website. Continued participation in the Program following posted changes constitutes acceptance of the revised Terms then in effect.
8.3. The decisions of SLS Las Vegas as to the administration and operation of the Program, any changes to these Terms and the provision of Benefits is final and binding.
8.4. SLS Las Vegas’s rights and obligations under these Terms are assignable at any time and to any entity without notification.
8.5. Violation of these Terms, including without limitation fraud, misrepresentation, misuse of the Club 52 Card or Benefits, or other improper conduct, as determined by SLS Las Vegas at its sole discretion, may subject the Member to termination or suspension from the Program and legal action by SLS Las Vegas or applicable governmental authorities. In addition, SLS Las Vegas reserves the right to initiate legal action to recover damages, including attorneys’ fees, incurred to prosecute or defend any action related to such wrongful conduct.
8.6. Membership in the Program does not confer any vested property or enforceable contract rights to Benefits.
8.7. By enrolling in the Program and obtaining a Club 52 Card, each Member acknowledges and agrees to all terms and conditions applicable to the entire Program.
8.8. SLS Las Vegas is not responsible for products or services offered by other companies in connection with the Program.
8.9. If for any reason a valid Benefit that was issued to a Member is confirmed to have been erroneously deleted, lost, destroyed, or improperly denied, SLS Las Vegas may re-issue the Benefit or a comparable Benefit at its sole discretion. In no event shall SLS Las Vegas be obligated to re-issue a Benefit or liable for any direct, indirect or consequential damages, lost revenue, or profits allegedly arising from participation in the Program.
8.11. Members may opt out of receiving marketing communications from SLS Las Vegas by contacting SLS Las Vegas as described in Section 8.13 below. Approved changes will be made to the Program’s active databases within a reasonable timeframe. In order for the Member to retain access certain accrued benefits and features, certain requests may not be fulfilled. If a Member unsubscribes from marketing communications, that Member may continue to receive certain communications, such as transactional, customer service, or other relationship messages, messages about that Member’s Account and profile, and emails in response to communications or requests for information. Please also note that SLS Las Vegas may not be able to remove a Member’s information from the databases of third parties to whom personal information has already been provided as of the date of the opt-out request.
8.12. Each Member further acknowledges and agrees that all communications with SLS Las Vegas arising from or related to the Program may be monitored for quality assurance purposes.
8.13.
